Don’t Wait for Social Security Disability Benefits

A client of Newman Boyer & Statham Ltd., “Herbert” was a steelworker who, after retiring from the steel mill, went to work as a cashier/stocker in a gas station to supplement his pension. After a couple of years, his hands and neck began to bother him due to arthritis. Social Security denied his disability claim, stating that he could not do his past work but he could do other kinds of work. Basing the case on Herbert’s multiple impairments, some of which were the result of long years in the steel mill, Attorney Kristin M. Boyer obtained disability benefits and, ultimately, Medicare coverage for Herbert.

Another client, “Norma,” was a fifty year old secretary who could no longer perform her duties on a full-time, regular basis due to migrating symptoms from lupus. She had good days and bad days at work — finally, she consulted Mrs. Boyer inquiring about a possible application for disability benefits. Mrs. Boyer sent Social Security rules to Norma to discuss with her physician. The doctor, upon listening to Norma’s full account of her symptoms and upon reviewing SSA’s disability requirements, supported Norma’s application which was ultimately approved by Social Security.

Today, there are approximately 8.8 million employees receiving Social Security Disability payments. However, applicants are waiting longer and longer to receive such benefits and too often, the process involves several denials and lengthy appeals. The most unfortunate cases are dismissed because the claimant died while waiting for benefits. Social Security Disability benefits are paid to employees who cannot work because of a medical condition expected to continue for at least one year or result in death.

If a medical condition prevents you from working, speak with a Chicago Social Security Disability Insurance attorney to determine if you are entitled to receive Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI).
